OFFICIAL CONTEST RULES

Fly Clase Premier with AIR MILES^® and Aeromexico^® Social Contest (the “Contest”)

NO PURCHASE OR USE OF MILES IS NECESSARY

The Contest is open to Canadian resident AIR MILES Collectors who are 18 years of age or older. See Rule 2, below.

1. Contest Sponsor: The Contest is sponsored by AIR MILES Loyalty Inc., doing business as AIR MILES or the AIR MILES Reward Program (the “Contest Sponsor”), with its head office located at 100 King Street West, 21st Floor, Toronto ON M5X 1A1. 
   
   
2. Eligibility: The Contest is open only to Canadian resident AIR MILES Collectors (“Collectors”), who are 18 years of age or older at the time of entry, except employees, representatives and agents of the Contest Sponsor, its affiliates and their respective advertising and marketing agencies, Contest administrators, judges and persons domiciled with any of the above. The Collector is the individual in whose name the collector number has been established (the “Collector Number”) or, in the case of a Business Collector, the principal associated with the Business Collector Number, as determined by the Contest Sponsor, and this is the individual to whom the Prize (as defined below) will be awarded if they are selected and declared a winner. Canadian residence will be determined by the mailing address associated with the Collector Number. If you are not already an AIR MILES Collector, you may become one by enrolling online at ca. By enrolling to become an AIR MILES Collector, you agree to be bound by the terms and conditions of the AIR MILES Reward Program as amended from time to time.
   
   Online access and an email and public Facebook and Instagram account are required in order to participate in this Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts. If you do not already have an account, you can obtain one for free at www.instagram.com or www.facebook.com. Additional terms and conditions associated with the creation of an Instagram or Facebook account may apply. 
   
   
3. Agreement to Contest Rules: By participating in the Contest, you fully and unconditionally agree to and accept the Official Contest Rules and the decisions of the Contest Sponsor and its Contest administrators and judges, which are final and binding in all matters related to the Contest.
   
   
4. Contest Period:The Contest starts Tuesday, December 3, 2024, starting at 10:00:01 a.m. ET, and closes at 11:59:59 p.m. ET, on Thursday, December 5, 2024 (the “Contest Period”).
   
   
5. How to Enter. No Purchase Necessary: A Collector will receive one (1) entry (each an “Eligible Entry” and collectively “Eligible Entries”) when they:
   • Follow @airmiles_canada on Instagram or AIR MILES Canada page on Facebook AND @aeromexico on Instagram or AeromexicoNA on Facebook;
   • During the Contest Period, like the Fly Clase Premier with AIR MILES® and Aeromexico® Social Contest post posted at the start of the Contest Period on the AIR MILES Canada page on Instagram or on the AIR MILES Canada page on Facebook;
   • During the Contest Period, post/reply to the post described at Step (ii) with a comment that includes the answer to the Fly Clase Premier with AIR MILES® and Aeromexico® Social Contest question using the hashtag #AIRMILESxAeromexico and #AeroMexico on the @airmiles_canada page on Instagram or on the AIR MILES Canada page on Facebook; and
   • Tag a friend or a family member in the comment/reply described at Step (iii).

   To be eligible, Collectors must have a public social media account and follow AIR MILES on the social media channel in which they submitted their comment.

   The Contest Sponsor reserves the right to reject an Eligible Entry, in its sole discretion, that may be deemed offensive, distasteful or inappropriate.

   All Eligible Entries are subject to verification. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility in a form acceptable to the Contest Sponsor including, without limitation, government-issued photo identification to award this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of an Eligible Entry in this Contest will be the contest server machine’s record of time.

6. Entry Limits and Odds: There is a limit of one (1) Eligible Entry per Instagram comment, and one (1) Eligible Entry per Facebook Comment, for a total limit of up to two (2) Eligible Entries per Collector Number for the Contest Period.  If the Collector exceeds the limit of two (2) entries per Collector Number during the Contest Period, as determined by the Contest Sponsor, their entry will be void. The odds of winning the Prize will depend on the total number of Eligible Entries received during the Contest Period.
   
   
7. Prizes:There is a total of one (1) prize available to be won (the “Prize”), consisting of the following:

   The actual value of the Prize may vary and is subject to several factors, including but not limited to the date and time of travel, the departing airport, the destination, and usual fluctuations in demand and pricing for air travel. Any difference between the approximate retail value and the actual cost of the Prize will not be awarded.

   All elements of the Prize are not transferable or convertible to cash, or refundable, and must be accepted as awarded. Prize details shall be at the Contest Sponsor’s sole discretion. Where applicable, Prize elements will be awarded by the Contest Sponsor based on the mailing address and/or email address associated with the Collector Number of a confirmed winner. In the case of loss, theft, mutilation, alteration or unauthorized use, a Prize and its elements will not be reimbursed or replaced. Except as expressly stated herein, a confirmed winner (the “Winner”) is responsible for all applicable taxes, fees and surcharges, if any, in respect to his/her Prize and/or the use or redemption thereof.

   No compensation will be provided for failure by a confirmed winner to accept a Prize as awarded. Contest Sponsor gives no representations, warranties or conditions, whether express or implied, in respect to a Prize or any elements of a Prize.

   The Prize is subject to certain further restrictions:

   • If the guest of the Prize winner (the “Guest”) is under the age of majority, the Winner must be the parent/legal guardian of the Guest. Once selected by the Winner, Guest cannot be changed without the express consent of Aeromexico (the “Prize Provider”), which may be withheld for any reason.
   • In addition to the Winner (see Rule 8), Guest must also sign a Prize Acknowledgment and Release Form, in a form satisfactory to Contest Sponsor, as a condition of participating in the Prize. If a Guest is under the age of majority in his/her province or territory of residence, a parent or legal guardian of the Guest will be required to sign or submit the Prize Acknowledgement and Release Form on behalf of their minor child. If the parent or legal guardian of the Guest does not sign or submit the Prize Acknowledgement and Release Form, the Guest will not be permitted to participate in the Prize.
   • The Winner and his/her/their Guest are responsible for all other expenses not stated as included herein. Changes to flights or passenger names are not accepted once the booking has been confirmed without the express consent of Prize Provider, which may be withheld for any reason. Laws, regulations, international conventions and conditions of carriage govern the Prize. Other restrictions may apply.
   • Prize fulfillment and travel are subject to certain restrictions and air travel/flight availability. The Prize must be booked in accordance with the procedure, conditions and restrictions designated by the Prize Provider (as set out in Schedule “A” to these Official Contest Rules). Black-out dates apply. No extensions will be granted. Certain travel restrictions apply including airline carrier’s regulations and conditions. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades.
   • The Winner and his/her/their Guest are responsible for all expenses other than those included in the Prize. Any costs or expenses, which may include transportation between Winner’s residence and the departure airport, baggage fees, insurance (health, travel and medical), parking fees, the booking of a hotel or other accommodations (and any additional expenses associated with a stay at a hotel or other accommodations), food or beverages, alcoholic beverages, merchandise, souvenirs, incidental expenses, local and long distance telephone calls, tips, gratuities, service charges, any taxes, and all other personal expenses of any kind not specifically identified in these Official Contest Rules as part of the Prize are the responsibility of the Winner and his/her/their Guest. The Contest Sponsor and/or Prize Provider are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any element of the Prize and the Winner and his/her/their Guest will not be compensated in the event of such delay, cancellation or other event described herein. Laws, regulations, international conventions, flight tariffs and conditions of carriage govern flight elements of the Prize. Other restrictions may apply.
   • The Winner may not charge any Guest for participating in the Prize. The Prize is awarded “as is” with no warranty or guarantee, expressed or implied, being provided by Contest Sponsor or Prize Provider.
   • The Winner and his/her/their Guest must have the legal right to enter and leave the destination to which they are bound. They are fully responsible for obtaining, at their own expense, all documentation necessary for the trip as required by the authorities concerned, including, but not limited to, visas, passports, vaccinations and certificates. These documents shall be obtained before departure.
   • All travel documentation that may be required (visa, passports, etc.) are the Winner’s and his/her/their Guest’s responsibility and must be obtained prior to departure. Passports for all travellers must be valid for a minimum of 6 months from the date of departure.
   • It is strongly recommended that the Winner and his/her/their Guest purchase travel and/or medical insurance at time of reservation as a measure of added protection. Travel insurance may (but is not required) to be purchased through AIR MILES Travel Insurance at https://www.airmiles.ca/en/travel/travel-insurance.html  
   • None of the Contest Sponsor, Prize Provider or their respective affiliates shall assume any responsibility of any nature whatsoever for any delay, postponement, suspension, rescheduling or cancellation of the Prize or any portion of the Prize, for any reasons whatsoever, including, but not limited to, weather conditions, equipment breakdown or failure of any flight(s), and the Winner and his/her/their Guest are not entitled to be compensated in the event of such delay, cancellation or other event described herein.
8. Winner Selection:A random draw for the Prize from all Eligible Entries received during the Contest Period will be conducted on Friday, December 6, 2024, at 10:00 a.m in Toronto, Ontario. The draw will be conducted by a judging organization whose decisions will be final and binding. If for any reason there are no Eligible Entries, the Prize will not be awarded. In order to be declared a winner, selected entrant must be an AIR MILES Collector and must first correctly answer, unaided, a time-limited mathematical skill-testing question in the form provided by the Contest Sponsor or its representatives and otherwise comply with the Official Contest Rules. The Contest Sponsor or its representatives will make reasonable attempts to contact the selected entrant using the social media platform that they used to enter the Contest and/or telephone number(s) recorded in respect to his/her Collector Number, as the case may be. If a selected entrant cannot be contacted or has not responded within two (2) days of the date when contact was first attempted, is not eligible in accordance with these Official Contest Rules, does not correctly answer the mathematical skill-testing question, or does not otherwise comply with these Official Contest Rules, then the selected entrant is disqualified and will not receive the Prize and another entrant may be selected. A selected entrant must sign and return to the Contest Sponsor within three (3) days of receipt a Prize Acknowledgement and Release Form, in form satisfactory to Contest Sponsor, which includes a standard declaration of compliance with the Official Contest Rules and release form in order to be awarded a Prize. Failure to sign and return the Prize Acknowledgement and Release Form within three (3) days of receipt will result in forfeiture of the Prize.
   
   
9. General:The Contest Sponsor reserves the right to use the Winner’s name, city of residence, comments, likeness, photograph, voice and statements without further compensation, in connection with any advertising and publicity carried out by or on behalf of the Contest Sponsor in relation to the Contest or the AIR MILES Reward Program, in any media throughout the world in perpetuity. The first name or initials and city name of the Winner may also be posted on www.airmiles.ca, the airmiles Canada profile on Instagram and the AIR MILES Canada page on Facebook.
   

   The Contest Sponsor is not responsible for any technical, hardware, software or telephone failures of any kind, or lost or unavailable network connections or garbled or deleted computer network transmissions, or failed, incomplete, garbled, misdirected or lost entries or inaccurate capture of entry or use of Miles information, even if it limits the ability to participate in the Contest. Any entry that occurs after a system failure is deemed a defective entry and is void and will not be honoured. The Contest Sponsor and Prize Provider are not responsible for any injury or damage to persons (including each winner) or property arising from the Contest or Prize, or which may be caused, directly or indirectly, in whole or in part, from accessing or transmitting any material from any website associated with the Contest (the “Website”) regardless of whether the material was prepared by the Contest Sponsor or a third party or is connected to the Website by hyperlink. All entries must be received during the Contest Period. All entries and prize claims are subject to verification by Contest Sponsor and will be void if not obtained through legitimate channels, or if not original, or if obtained other than in compliance with these Official Contest Rules. The Contest Sponsor will not accept screen shots or other evidence of winning or entry in lieu of its verification process. Proof of sending is not proof of receipt. All entries become the property of the Contest Sponsor and will not be returned.

   Online and email entries must be made by an individual entrant only, using his or her original, manual keystrokes. Use of any automated system including robotic or form-filling software to enter or participate is prohibited and will result in disqualification of all entries by anyone using such assistance. 

   The Contest Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Contest Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law and, should such an attempt be made, the Contest Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Contest Sponsor’s failure to enforce any term of these Official Contest Rules shall not constitute a waiver of that provision.

   The Contest Sponsor reserves the right, in its sole discretion, to substitute a prize with one of equal or greater value, to cancel, terminate, amend and/or suspend the Contest without prior notice at any time and for any reason including, without limitation, if viruses, bugs, unauthorized human intervention, attempts to disrupt the Contest or other causes beyond the Contest Sponsor’s control corrupt or affect the administration, security, fairness or proper play or conduct of the Contest. In no event will the Contest Sponsor be liable for more prizes (in quantity or amount) than that specified in the Official Contest Rules.

   All entries become the permanent property of the Contest Sponsor and none will be returned. No correspondence will be entered into, except with the selected entrants. The Contest is subject to all applicable federal, provincial and municipal laws. 

   By entering this Contest, each entrant expressly consents to the Contest Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest and in accordance with these Official Contest Rules and the Contest Sponsor’s privacy policy (available at: https://www.airmiles.ca/arrow/PrivacyPolicy). This section does not limit any other consent that an individual may provide the Contest Sponsor or others in relation to the collection, use and/or disclosure of their personal information. 

   The Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram, or Facebook. By entering this Contest, you understand that you are providing your information to the Contest Sponsor and the third parties it has engaged to assist it in administering the Contest and not to Instagram or Facebook. The information you provide will only be used in accordance with the Contest Sponsor’s Privacy Policy. The owners and operators of Instagram, or Facebook, are completely released from all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Contest Sponsor and not to Instagram, or Facebook.

   The name of each winner may be obtained by sending a request with a self-addressed, postage-stamped envelope to “Fly Clase Premier with AIR MILES® and Aeromexico® Social Contest, Winner List Request, Attention: AIR MILES Marketing, 100 King Street West, 21st Floor, Toronto ON M5X 1A1” until May 5, 2025. The first name or initials and city name of each winner may also be posted on www.airmiles.ca.

Schedule “A”

 Terms and Conditions of Aeromexico Travel Certificate 

• Applicable from any gateway operated by Aeromexico to / from any destination operated by Aeromexico between Canada and the Republic of Mexico. 
• Tickets are valid on Aeromexico flights only 001-3999 and do not apply on any code share flights. 
• Booking class “O”. 
• Certificates are valid for travel for one year from date of issuance. 
• The validity of the travel certificate cannot be extended. 
• The Travel Certificate has no cash value. 
• Tickets once issued are non-transferable and cannot be reissued. 
• Applicable taxes and surcharges will apply and must be paid before ticket is issued by traveller. 
• Form of Payment: Credit Card. 
• Holiday and high demand periods will have blackout dates. 
• Travel arrangements need to be made two weeks in advance. 
• Traveler is responsible to check in two hours prior to departure. 
• Full details and applicable terms will be included with certificate.
